LAA accident insurance: the legal obligation

Every employer must insure its employees against occupational accidents and, from 8 hours a week, against non-occupational accidents. The LAA provides medical treatment, a daily allowance of 80% of the insured salary up to a legal ceiling (art. 17 LAA), and pensions.

IJM: loss of earnings due to illness

The LAA does not cover illness. In the event of absence, the Code of Obligations requires the employer to keep paying the salary for a period that depends on length of service. Daily sickness allowance insurance (IJM) can replace this obligation: if its benefits are at least equivalent, the insurer pays the allowances instead of the employer. It is not required by law, unless a collective labour agreement says so.

Supplementary LAA insurance

The LAA caps the insured salary. Supplementary insurance covers the share above the ceiling and can improve benefits, for example the hospital ward.
